Yspekh Sàrl (hereinafter "Yspekh"), a company domiciled at Grand'Rue 153, 1454 L'Auberson (Vaud), is the controller of the personal data collected under this privacy notice.

We respect your privacy and are committed to full transparency about how we collect, use and share your personal data, in accordance with the Swiss Federal Act on Data Protection (FADP) of 25 September 2020.

This notice explains how we handle the personal data we collect from you, that you provide to us, or that we may obtain from other sources. This covers the various ways you interact with us, including in person, by e-mail or telephone, through our website (www.yspekh.ch), or through our social media pages.

The purpose of this privacy notice is:

• to list the personal data we collect from you;
• to inform you about the cookies we set;
• to explain the purpose of processing this data and on which legal bases we process it;
• to identify with whom this data is shared and whether it is transferred abroad;
• to set out the security measures we take in relation to this data;
• to inform you of your rights regarding your personal data and how to exercise them.

Our privacy notice

By interacting with us or providing us with your personal data, you accept the rules described in this notice. If you do not accept these rules, please do not use or visit our website, and do not provide us with your personal data.

Yspekh reserves the right to amend this notice; changes take effect upon publication on our website. Please check our website regularly for any changes.

What personal data do we collect?

When you interact with us — for example through our website, our social media accounts, by e-mail or telephone, when you visit our premises or at events — we may collect your personal data.

We only collect personal data that you provide to us, that results from your actions on our website, and/or that we need in order to offer or improve our services, or on the basis of another legitimate interest:

• Contact and identification information, such as surname, first name, telephone number, postal and e-mail address, professional affiliation such as employer name, position held, department and line manager, as well as communication metadata such as your IP address, timestamp, browser (including language and version) and geolocation;
• Information from your social media accounts, such as profiles, photographs, videos, stories, comments and other content generated by you in which our brands and/or products and services are mentioned or appear, where you authorise a third-party social network to share your personal data;
• Professional information such as profession or occupation and/or previous professional experience, educational institutions attended, references or certifications, if you respond to a job offer or send an unsolicited application;
• Order and invoicing information, when you place an order in our online shop: items ordered, quantities, amounts, billing and delivery address, company name, and — for a training registration — the names of the participants. We collect no card payment data: our orders are settled against invoice.

We collect this data directly from you when you provide it.

We may also obtain personal data from third-party data aggregators (for example Google), promotional partners, public sources and social media platforms. This information may include personal data from your profile on a social network which you authorise that network to share with us in accordance with its rules.

Cookies and audience measurement

Cookies are small text files placed on your device by the websites you visit, so that information about your browsing can be collected.

Our website uses two categories of cookies:

• Strictly necessary cookies. They provide the basic functionality and security features of the website. They are set automatically when you visit the site and cannot be disabled without loss of functionality. They store no personally identifiable information.
• Audience measurement cookies. We use Google Analytics 4 to understand how our site is used (page views, traffic sources, devices) and to improve it. These cookies are set as soon as you arrive on the site. You can refuse them at any time, without having to give a reason: through the banner displayed on your first visit, or afterwards through the “Manage cookies” link at the bottom of every page. Your refusal is stored on your device and respected on your subsequent visits.

You may change your choice at any time via the “Manage cookies” link at the bottom of every page. You can also configure your browser to block cookies or warn you before accepting them; blocking strictly necessary cookies may prevent parts of the site from working.

Google Analytics is a service provided by Google Ireland Limited. Audience measurement data may be transferred outside Switzerland; we have enabled IP address anonymisation and do not use this data for advertising purposes.

Cookieless audience measurement. We also use Matomo, audience measurement software that we host ourselves on servers located in Switzerland. Matomo sets no cookie on your device and transmits no data to any third party: the statistics stay on our servers and serve only to understand which pages are consulted and to improve the site. Your IP address is truncated before it is stored, so that it cannot identify you, and detailed browsing data is deleted after six months. If your browser sends a “Do Not Track” signal, we do not measure you at all. You may also object to this measurement at any time by writing to info@yspekh.ch.

Why do we collect your personal data and on what legal bases?

We collect and use your personal data in order:

• to provide you with our products and services;
• to inform you about our products and services and to promote them generally;
• to respond to job applications, unsolicited or otherwise;
• to process your orders: preparation, delivery, invoicing, payment tracking and after-sales service, as well as organising the training sessions you register for;
• to keep records of our activities in order to comply with our financial or legal obligations.

We process your data on a pre-contractual and/or contractual basis in all your interactions with Yspekh relating to our products and services, including your initial contact with us or your requests for information. We process your personal data on the same basis if you respond to a job offer or send us an unsolicited application.

It is in our legitimate interest to promote our products and services through social media or by other means, and to measure the audience of our website. We may process your personal data on this basis. In that case, please note that you have the right to object to the processing by contacting us at info@yspekh.ch.

Finally, we have legal obligations under national and international law. In order to meet these obligations, we process your personal data for compliance purposes.

With whom do we share your personal data, and is it transferred abroad?

We do not sell your personal data.

We disclose your personal data only where necessary, and solely to the following categories of recipients:

• our hosting provider, for the operation of the website;
• our e-mail delivery provider, for confirmation and follow-up messages;
• the carrier handling delivery, when you order an item to be shipped;
• our accountants and invoicing tools, to issue and retain accounting records;
• the authorities, where the law requires it.

We neither sell nor rent your data to third parties, and we pass it on to no other supplier.

Our website is hosted in Switzerland. The data you send us through the contact form or when placing an order is therefore processed in Switzerland.

There are two exceptions to this principle:

• the audience measurement data described above may, unless you have objected to it, be processed outside Switzerland by Google Ireland Limited;
• confirmation and follow-up e-mails pass through our delivery provider, whose servers may be located in the European Union.

How is your data stored, secured and retained?

We take all reasonable technical and organisational precautions to secure your personal data against loss, unauthorised access and other breaches. This data will not be shared with third parties except as provided in this notice.

When the personal information we collect is no longer required for a given purpose or on the basis of a legal requirement, we destroy or anonymise it.

We also undertake not to retain your personal data if you show no interest in our products and services for a defined period after the end of your last contact with us. Messages received through our contact form are deleted after twelve months.

Order-related data is an exception: accounting records — orders, invoices and supporting documents — must be kept for ten years under article 958f of the Swiss Code of Obligations. We therefore retain them for that period, then destroy them.

Your rights: accessing your personal data and requesting corrections

You can exercise your rights simply by contacting us at info@yspekh.ch.

You may request access to your personal data, as well as correct or update it. Where processing is based on legitimate interest, you have the right to object to it.

To help us handle your request, please provide your full contact details so that we can identify you securely.

You may also limit the use of tracking technologies such as cookies by configuring your browser to warn you before accepting them, or to refuse them.

Should you consider that we are not respecting your rights or our obligations, you may lodge a complaint with the Federal Data Protection and Information Commissioner (FDPIC).

This privacy notice, and any questions arising from or relating to it, are governed by Swiss law. You accept the exclusive jurisdiction of the courts at Yspekh's registered office.
